Dairy Farmers of America, Inc and its family of companies (“DFA”) is committed to safeguarding your privacy on our websites and in connection with our products and services. We use this Privacy Notice to describe how we collect, use, share, and safeguard personal information in a variety of contexts, including about individuals associated with our customers, vendors, and farmer-owners, along with visitors to our site.

Not all of the collection and processing described below will apply to you and will depend on the context in which you interact with DFA. Where noted in connection with a specific product or service, there may be additional elements of our privacy practices that are applicable in connection with that product or service (which will be noted on the DFA website offering that product or service). We may revise and update this Privacy Notice from time to time. The effective date of the last updated version is indicated at the top of this Privacy Notice. It is your obligation to check this page often for revisions to this Privacy Notice.

What information does DFA collect from you?

 We collect information in several ways. Our vendors may also collect information on our behalf. Some of the information we collect is personal to you, primarily information that you provide to us (such as when you register to receive communication from us or provide your information as a farmer-owner). “Personal Information” means any information that identifies or is capable of identifying you or your household. Other information is anonymous, aggregated, or otherwise does not directly identify you. The types of information we collect may include:

How do we collect information from you?

Direct Collection

We collect much of the information listed above directly from you. This includes information such as registration information, contact information, user submissions, and public postings. If you do not want to share your information, you can choose not to participate in the particular service or activity that collects the information from you. By providing us your personal information or by using our websites or applications, you consent to our collection, use, and sharing of personal information as described in this Privacy Notice. 

Automatic Collection – Cookies and Other Technologies

We use technologies (e.g., cookies or clear GIFs) to automatically collect certain information when you browse a DFA website, read pages, or download information. “Cookies” are small pieces of information that a website sends to a computer’s hard drive while a website is viewed. “Clear GIFs” are small, transparent graphic images placed on a website that can track user actions on the website. 

We’ll automatically collect and store: (i) the Internet domain and Internet protocol (IP) address (the number that is automatically assigned to your computer but does not identify you individually) from which you accessed that DFA website; (ii) the type of browser and operating system being used to access the DFA website; and (iii) the date and time of the access to the DFA website. This information is used to gather analytics, improve our websites, and to aid in troubleshooting site problems.

We may let third parties place tracking technologies on our website that collect analytics, record how you interact with our website, or allow us to participate in behavior-based advertising. This means that a third-party may use tracking technologies to collect information about your use of our website so that they can report analytics to us or provide advertising about products and services tailored to your interests. That third-party might also collect information over time and across different websites in order to serve advertisements on our website or other websites.

Depending on which of our websites you visit, cookies may deploy automatically or may require you to opt-in before they deploy. From Other Sources

How do we use your information?

With whom does DFA share my information?

Except as described in this Privacy Notice, we will not disclose your personally identifiable information unless we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below. Service Providers

We occasionally hire other companies to provide services on our behalf, including packaging, delivering, mailing, website development and operation, sending postal mail or email, analyzing website use, processing payments, or processing data.

Data in the Aggregate 

Some information we process is “deidentified,” meaning that it cannot reasonably identify, relate to, describe, be capable of being associated with, or be linked, to a particular individual. To the extent that we maintain and use deidentified information, we will not attempt to reidentify the information, except for the purpose of determining whether our deidentification processes satisfy our legal obligations.

We may also disclose your personal information when we believe disclosure is necessary (i) to investigate, prevent, or take action regarding illegal activity, suspected fraud, or other wrongdoing; (ii) to protect and defend the rights, property, or safety of our organization, our customers, our farmer-owners, our volunteers, our employees, our websites and application users, or others; (iii) to enforce our Terms of Use or other agreements or policies; (iv) and for other purposes as permitted by law.

We may share information within DFA. As we continue to develop our business, we may buy or sell businesses or assets. In the event of a transaction involving the sale of some or all of DFA’s businesses, customer and site visitor information may be one of the transferred assets and may be disclosed in connection with negotiations relating to a proposed transaction. In such case, the transferred information may become subject to different privacy practices.

We may also ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this Privacy Notice.

How long do we retain your information?

We retain your personal information for only as long as necessary to fulfill the purposes outlined in this Privacy Notice, including for the purposes of satisfying any legal or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purpose for which we obtained the information, and whether we can achieve those purposes through other means, as well as applicable legal requirements.

What security precautions are in place to protect against the loss, misuse, or alteration of my information?

We use administrative, technical, and physical security measures designed to protect personal information against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. Despite our safeguards, however, no website, application, or information system can ever be completely secure, so we cannot guarantee that the use of our systems, websites, or applications will be completely safe or secure. Your DFA account information and/or DFA profile is password-protected so that only you (or others that you authorize) have access to this personal information. We use SSL encryption technology for credit card numbers, bank account numbers, and passwords. Remember to sign out of your DFA account and close your browser window when you have finished your work.

Except as described in this Privacy Notice, our websites do not use security encryption measures. Information that you disclose via use of a DFA website (as with any site that is non-secure), by posting a message, or using e-mail, could potentially be collected and used by others. This may result in unsolicited messages from third parties or use of that information by third parties for their own purposes, legal or illegal. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or from our services, and you do so at your own risk. Once we receive your transmission, we use commercially reasonable efforts to ensure its security on our systems. 

In the event that we are required by law to inform you of a breach of your personal information, we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Choice / Opt-out

To ensure that you will not receive recurring marketing or other information from us unless you choose to, we will provide you with simple instructions on each marketing email from DFA for you to let us know that you have chosen to stop receiving such emails from us.

Your Privacy Rights

Residents of some jurisdictions may have certain additional rights. Please note, not all of the rights described below are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law. 

Access to Your Personal Information

You may request access to your personal information, and the confirmation of our processing of your personal information, by contacting us at the address described below. In some limited circumstances, you may also request to receive access to your data in a portable, machine-readable format. If required by law, upon request, we will grant you reasonable access to the personal information that we have about you. Note that California residents may be entitled to ask us for a notice describing what categories of personal information (if any) we share with third parties or affiliates for direct marketing. 

Deletion of Your Personal Information

You may request that we delete your personal information by contacting us at the address described below. If required by law we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another one of our business purposes. Right to Correct Information 

We rely on you to update and correct your personal information. You may ask us to correct information that is inaccurate or incomplete. Note that we may keep historical information in our backup files as permitted by law. 

Opt-Out of Targeted Advertising 

You may opt-out of online tracking based targeted advertising (e.g., cookies) by clicking the Manage Preferences link on the home page of the website you are visiting or the “Do Not Share” link on our homepage.

Submitting a Request

You may exercise the rights described above by contacting us as indicated in the “Contact Information” section below. If you disagree with how we handled a request, you may appeal our decision by contacting us with the subject line “Appeal.”

Note that, as required by law, we will require you to prove your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name, the last item you purchased from us, or the date of your last purchase from us. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct, or delete personal information about you in our files.

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. If you are an authorized agent submitting a request on behalf of an individual, you must attach their written permission indicating that you are able to act on another person’s behalf.

Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in their web browsers. While the United States Federal Trade Commission has endorsed DNT, our websites do not support DNT codes. Our websites limit tracking to the internal uses described above, including in connection with aggregated data. Our websites do not track your use across multiple websites. However, when we link to other websites not operated by DFA, these other websites may track your activity in different ways. Please review their privacy notices to understand how you may be tracked.

Children’s Privacy Practices

DFA does not directly and knowingly collect personal or non-personal information about or from children under the age of 13 through our websites, nor does DFA utilize any method of acquiring or verifying the age of visitors to our websites. When DFA collects information about children under the age of 16 in other contexts, it is only with the express permission of their parent or guardian. DFA does not sell personal information, including of children under 16. If a parent requests a review of information their child may have submitted, then DFA will make every reasonable effort to honor that request. In order to request a review or deletion of personal information your child may have submitted to DFA, please contact us using the information below. DFA is not responsible for the privacy practice of and use of children’s personal information by websites that DFA doesn’t operate and this Privacy Notice does not apply to those linked sites.

DFA may establish relationships with business partners that allow visitors to our websites to link directly to websites operated by these partners. DFA is not responsible for the content or privacy practice of third-party websites that may be linked from any DFA website. These links are meant for your convenience only and do not constitute sponsorship, endorsement or approval by DFA of the content, policies, or practices of those third-party sites, or any products or services which may be offered through that third-party website. If you connect to another party’s website through a link on one of our websites, you should read that website’s privacy notice to determine its privacy practices regarding the use of such website.

California Sensitive Information Disclosure

We collect the following categories of sensitive personal information (as defined under California law): social security number, precise geolocation, and financial information. This information is collected in order to process transactions, comply with laws, manage our business, or provide you with services. Note that we do not use such information for any purposes that are not identified within the California Privacy Rights Act Section 1798.121.
